IEC Code is unique code issued by DGFT – Director General of Foreign Trade. No person or entity shall make any Import or Export without IEC Code Number. IEC Code is the First primary document issued by Government of India as an Exporter/Importer. On the basis of IEC Code, business organisation can obtain various benefits on their exports/imports from Directorate General of Foreign Trade (DGFT).

What is Importer Exporter Code (IEC)

The first requirement before you start an import/ export business in India is to obtain an IEC. An IEC is necessary for import/export of goods. In case the import/export is of services or technology, IEC is required in only limited circumstances, when import/export is in ‘specified services’ or ‘specified technologies’, i.e. services or technologies in which international trade is restricted by the Government of India as they pertain to national security, such as dealing in nuclear weapons, automatic guns, etc.

ANo export or import shall be made by any person without an Importer Exporter Code (IEC) Number unless specifically exempted. An Importer/Exporter Code (IEC) number shall be granted on application to the competent authority.

BAn application for grant of IEC number shall be made by the Registered/Head Office of the applicant to the licensing authority concerned in the form specified and shall be accompanied by documents prescribed therein.

CAn Import Export Code No allotted to an applicant shall be valid for all its branches/divisions/units/factories as indicated on the IEC number.

DWhere an IEC Code/ Import Export Code No is lost or misplaced, the issuing authority may consider requests for grant of a duplicate copy of IEC number, if accompanies by an affidavit.

EIf an IEC holder does not wish to operate the allotted IEC number, he may surrender the same by informing the issuing authority. On receipt of such intimation, the issuing authority shall immediately inform all the RBI/Customs/Licensing authorities that the said IEC number has become inoperative.

FIf there is any change in the name/address or constitution of IEC holder/licensee/Actual User eligible for import without a licence/recognised status holders, as the case may be, shall cease to be eligible to import or export against the licence/IEC Number or any other facility permitted under the Policy and Handbook, after expiry of 60 days from the date of such change in his name or constitution, unless in the meantime,

a the IEC holder/licensee/status holders has got the consequential changes effected in the IEC number/licence or the recognition certificate, as the case may be, by the concerned licensing authority.

bthe Actual User has got the consequential changes effected from the concerned authority in the Industrial Licence issued by the Secretariat for Industrial Assistance (Ministry of Commerce and Industry) or Certificate of Registration as an Actual User issued by Director of Industries of the State Government or has received an acknowledgement for filing of a memorandum with the Secretariat for Industrial Assistance. Provided, however, the licensing authority issuing the IE Code may, condone the delay on payment of a penalty of Rs.5000/-.

Procedure for obtaining IEC

A An application must be made in the Aayaat Niryaat Form 2A (ANF 2A) format to the Regional Authority of the Directorate General of Foreign Trade (DGFT) in the region where the registered office of the company is situated.

B The DGFT has provided online filing facility for obtaining IEC and other authorizations. Form ANF 2A requires basic details of the business and its proprietors, partners or directors (as applicable), bank account details and a bank certificate (where the business has an account) stating the period for which the business has an account with the bank.

COne thing to be kept in mind is that thePermanent Account Number (PAN) is pre-requisite for grant of an IEC. And only one IEC can be issued against a single PAN.

DThe IEC issued is valid for all the branches or factories of the importer/exporter, as the case may be. Applications winch are complete in all respects are normally disposed of within two days. For practical purposes, you can provide for a week’s time (after factoring in the time required to make any changes in case your initial application is incomplete in some respect).
